Background and Purpose of Issuance:
The issuance was deemed necessary due to challenges faced by companies such as Apple, Samsung Electronics Vietnam, HP Vietnam, Panasonic Vietnam, and Viettel Import-Export Corporation in obtaining test results for the certification and compliance declaration of certain national technical standards (QCVN) for products listed in the product category.
The objective is to address temporary difficulties encountered by businesses in obtaining test results for certification and compliance declaration, facilitating customs procedures, and product circulation in the market. During the suspension period, businesses are not required to submit test results for the technical standards that have been suspended, streamlining customs clearance and market circulation processes.
Significance of Issuance:
The Circular aims to resolve temporary challenges faced by businesses, ensuring smooth import and circulation of goods. It also encourages businesses to enhance their understanding of testing requirements, improve the quality of testing activities, and participate in strengthening testing capabilities at designated testing facilities.
Content of the Circular:
The Circular suspends the application of several QCVN for specific periods, including:
- Suspension of 3 QCVN for 5G terminal equipment until December 31, 2023, and suspension of 1 QCVN for 5G base stations until June 30, 2024.
- Suspension of 17 QCVN for maritime, satellite, and multi-mode road/rail traffic equipment due to insufficient testing capabilities until June 30, 2024.
- Partial suspension of 18 QCVN (technical requirements for testing under harsh/limited conditions and some other requirements) due to insufficient testing capabilities or insufficient time to obtain test results from designated or recognized testing facilities until June 30, 2024.
Transition Handling:
- The Circular applies from July 15, 2023, to the effective date of Circular No. 04/2023/TT-BTTTT.
- During the suspension period, products falling under the suspended standards are exempted from certification and compliance declaration procedures for the suspended technical standards.
- After the suspension period:
- All products under suspension must undergo certification, compliance declaration, and quality testing according to the regulations specified in Circular No. 04/2023/TT-BTTTT.
- Certificates issued during the suspension period remain valid until the expiration date specified in the certificate.
- Products falling under suspension, if continued in production or import, must undergo supplementary certification and compliance declaration for the suspended technical standards or undergo re-certification and compliance declaration with full technical standards.
Effective Date:
Circular No. 10/2023/TT-BTTTT takes effect from the date of signing.
